Programme Overview:

This one-day programme is designed for those who would benefit from an update on current case law and best practice in the areas of employment law and HR. Those attending will build their competence and confidence in these critical areas by ensuring that they have the most up to date legal and case law approaches.

Programme Outcomes:

On completion of the programme, participants will:

  • Have a clear understanding of the current issues arising in key areas of employment legislation
  • Be capable of dealing with queries and questions on each of the topics covered
  • Confidently look at policies and procedures that are currently in place with a critical eye
  • Acquire the current best practice approach to dealing with issues
  • Understand current case law and be aware of new issues that are arising almost daily
  • Have the tools for dealing with complex employment relationships
  • Spot potential risks for their organisation of possible claims from current or ex-employees
  • Have an overview and understanding of key aspects of employment legislation

Approach:

The law, by statute and judgement, is placing an ever-increasing burden on the employment relationships. Failure to comply with the law is both costly and time-consuming. Experienced Ibec staff who deal with a variety of real life situations on a daily basis present this course. They will present the issues in a practical manner illustrating the key points with the use of realistic case examples and case law.

Programme Overview
This programme will give managers and HR specialists the confidence to deal effectively with problems that arise in the context of the Unfair Dismissals Acts.

Programme Outcomes:
On completion of the programme, participants will be able to:

  • An appreciation of the importance of the principles of natural justice and the implications of them when managing disciplinary issues
  • How to manage poor performance
  • Managing absence within the law
  • How to deal with serious/gross misconduct
  • Understand the current best practice approach to dealing with issues in the area of discipline and dismissal
  • Know the legislative background to disciplining and the relationship between the unfair dismissals legislation, the equality legislation, industrial relations and any other relevant piece of legislation
  • Understand current case law and be aware of new issues that are arising almost daily
  • Build confidence to deal with queries and questions on the topics covered
  • Deal with all of the aspects of a disciplinary procedure up to and including dismissal
  • Critically analyse current disciplinary policies and procedures

Discriminatory dismissals

  • Discriminatory dismissals under the employment equality acts Disability and reasonable accommodation
  • Pregnancy related dismissals
  • Redress under the equality legislation

Fair procedures and Natural Justice

  • Importance of adhering to the principles of natural justice when dealing with disciplinary matters
  • Code of Practice on Grievance and Disciplinary Procedures (S.I. No. 146 of 2000)

Approach:
There are a number of activities and case studies as part of the course to ensure that the key knowledge and skills are practiced. Programme participants are encouraged to express their views and experiences. The programme facilitates participant discussion to ensure a thorough understanding of the key points and their application. Real life case studies and exercises will be used to ensure a real practical understanding of each topic.
